By booking or participating in any driving lesson or driving program with Decide To Drive, you agree to the following Terms & Conditions.

Student Agreement & Waiver

Before participating in any driving lesson or driving program, all students must read, agree to and sign the Decide To Drive Student Agreement, Waiver & Consent Form.

For students under 18 years of age, the waiver must also be accepted by a parent or legal guardian.

Decide To Drive reserves the right to refuse or cancel any booking where the required waiver has not been completed.

Driving Programs

Driving programs are designed to provide structured driver coaching over a specified period. Participation in a driving program does not guarantee completion if the student fails to comply with these Terms & Conditions, the Student Agreement or the reasonable directions of their driving coach.

Decide To Drive reserves the right to suspend or terminate a student's participation in a driving program at its sole discretion, including (but not limited to) circumstances involving:

- Unsafe driving behaviour.

- Aggressive, abusive or inappropriate conduct.

- Repeated failure to follow the reasonable instructions of a driving coach.

- Non-payment of fees.

- Any conduct that places the student, instructor, vehicle or other road users at unnecessary risk.

Where a driving program is terminated by Decide To Drive, any refund or outstanding balance will be assessed on a case-by-case basis.

For programs paid in full upfront, a partial refund may be provided after deducting the value of lessons already delivered and any applicable administrative costs.

For programs paid by weekly direct debit, payments will cease once the program has been formally terminated. Any outstanding amounts for services already provided remain payable.

The decision to provide a refund or credit remains at the sole discretion of Decide To Drive, subject to the requirements of the Australian Consumer Law.

Acceptance

By booking a lesson or enrolling in a driving program, you acknowledge that you have read, understood and agree to these Terms & Conditions together with the Decide To Drive Student Agreement, Waiver & Consent Form.

To ensure lesson times remain available for all students, Decide To Drive operates the following cancellation policy.

Rescheduling or Cancelling a Lesson

  • Lessons cancelled or rescheduled with at least 48 hours' notice may be transferred to another available appointment at no additional charge.

  • Lessons cancelled with less than 48 hours' notice may be charged the full lesson fee.

  • Failure to attend a scheduled lesson without notice ("no-show") will result in the full lesson fee being forfeited.

Late Arrival

Students are expected to be ready at the agreed pickup location and time.

If a student is late:

  • The lesson will finish at the originally scheduled time.

  • Additional time cannot be guaranteed.

  • Significant delays may be treated as a late cancellation or no-show at the discretion of Decide To Drive.

Instructor Delays

If your driving coach is running late due to traffic, weather, a previous lesson running over or another unforeseen circumstance, every reasonable effort will be made to notify you.

Where practical, the lesson time will be extended or rescheduled so that you receive your full booked lesson.

Cancellations by Decide To Drive

Decide To Drive reserves the right to postpone or cancel lessons due to circumstances including, but not limited to:

  • Severe weather.

  • Vehicle mechanical issues.

  • Instructor illness or emergency.

  • Road closures.

  • Safety concerns.

  • Any circumstance beyond the reasonable control of the business.

Where this occurs, students will be offered a replacement lesson at no additional cost or, where appropriate, a refund.

Refunds

Refunds will be provided where required under the Australian Consumer Law.

Unless otherwise required by law, refunds will not be provided for:

  • Change of mind.

  • Missed lessons.

  • No-shows.

  • Late cancellations.

  • Forced lesson termination due to unsafe, abusive or inappropriate behaviour.

Student Fitness to Drive

For the safety of everyone involved, Decide To Drive may refuse or terminate a lesson if a student appears affected by alcohol, drugs, medication, fatigue, illness or any other condition that may impair their ability to drive safely.

Where a lesson cannot proceed for these reasons, the lesson may be treated as a forced termination.

At Decide To Drive, we stand behind the quality of our driver coaching and are committed to helping every student become a safe, confident and capable driver.

Money-Back Guarantee

If, upon completing your enrolled driving program, you are genuinely not satisfied with the coaching and service you have received, you may request a full refund of the amount you have paid for your driving program.

Refund requests must be submitted within 14 days of completing your driving program and will be assessed in good faith by Decide To Drive.

Work for FREE Guarantee

If you complete your enrolled driving program, receive your driving coach's approval to sit your driving test and are unsuccessful in obtaining your driver's licence, Decide To Drive will continue providing driver coaching at no additional coaching cost until you successfully pass your driving test.

This guarantee applies provided that:

- You have completed your enrolled driving program.

- You have followed the reasonable guidance and instruction of your driving coach.

- You continue to undertake driving tests within a reasonable timeframe.

- Your learner licence remains valid and you remain legally eligible to undertake driving lessons and a driving test.

Guarantee Conditions

This guarantee does not apply where a student:

- Withdraws from their driving program before completion.

- Is removed from a driving program due to a breach of Decide To Drive's Terms & Conditions or Student Agreement.

- Provides false or misleading information.

- Becomes medically or legally unable to drive.

- Fails to maintain scheduled lessons or reasonable communication with Decide To Drive.

Decide To Drive reserves the right to verify eligibility for this guarantee and to decline claims that do not meet the above conditions or where doing so would be inconsistent with the Australian Consumer Law.
